Terms and Conditions of Membership
These terms and conditions form your membership contract with Triathlon New Zealand Incorporated.
Definitions
1. ‘Tri NZ’ means Triathlon New Zealand Incorporated
‘Membership’ means Triathlon New Zealand Membership and includes the brand "Tribe” under which Triathlon New Zealand Membership may be promoted and run from time to time
‘Membership Benefits’ means Triathlon New Zealand membership benefits, including membership discounts, services and products offered to you from time to time
‘we’, ‘our’ or ‘us’ means Triathlon New Zealand Incorporated
‘our website’ means the Triathlon New Zealand Incorporated internet site located at www.triathlon.org.nz

Start of Membership
2. Your membership contract will commence when you receive your notification of acceptance of your membership application.
Membership Validity
3. The Tri NZ Membership year runs seasonally from 1 November to 31 October and will roll over automatically each year. At that point members will be sent clear communications to opt out if they so wish.
Termination of Your Membership
4. You may terminate your membership with immediate effect by giving us notice at any time.
5. We may terminate your membership with immediate effect in accordance with the provisions relating to this in the Tri NZ Constitution.
Membership Benefits
6. All membership benefits that may be offered to you from time to time will be provided on a discretionary basis and may be revised, suspended or withdrawn by us at any time.
7. All offers of membership benefits shall be subject to these terms, any other rules or terms that may apply to any specific membership benefits and any user guides or other instructions given to you. The rules or terms of any specific membership benefits will prevail over the general terms in the event of any conflict.
Your Personal Information
8. We, our employees, sub-contractors and agents may use any personal information you provide or we otherwise hold about you (whether or not related or pursuant to this contract) to:
a. Identify you when you make enquiries by telephone, post, email or in person
b. Help administer your accounts (if any) and your membership benefits including to write to, email or telephone you with information about such membership benefits from time to time;
c. Help us to detect fraud or loss
d. Write to, email or telephone you with information about other services and products offered by us and those of our selected partners or sponsors, and we may use information about your use of membership benefits, services and products to help us contact you about which such services and products are likely to be of interest to you.
9. You must keep your address or any other personal information up to date on our website by using your personalised log in and password, or by immediately in writing notifying us of these changes.
Other Rules
10. It is a condition of your membership that you abide by the Tri NZ Constitution and Tri NZ Race Rules, including all aspects relating to the drug codes of the World Anti Doping Agency and Drug Free Sport New Zealand.
11. By applying for membership, you acknowledge that Tri NZ is the governing body in New Zealand for Triathlon, Duathlon, Aquathlon, Winter Triathlon and Multisport and agree to recognise it’s authority to govern the sports of Triathlon, Duathlon, Aquathlon, Winter Triathlon and Multisport.
Liability
12. We warrant that the membership services we provide will be provided using reasonable care and skill. We do not warrant that the services will be uninterrupted or error free, and give no other warranty, guarantee or representation as to the performance of any of the same.
13. Nothing in these terms will affect your statutory rights as a consumer
14. It is a condition of membership that you agree to indemnify Tri NZ from and against all costs claims demands damages or actions that may be brought or may lie against it for any matter in any way relating to or arising from your actions or your membership.
Changes to these terms
15. We may make additions or changes to these terms on the giving of reasonable notice, where we reasonably consider it necessary to do so. If the addition or change is to your detriment, you may, within 21 days of us giving you notice of the addition or change, terminate your membership under clause 9.
General
16. We may provide any membership benefit to you through any agent or sub-contractor appointed by us in our absolute discretion.
17. Nothing in these terms shall give any rights to any person other than you.
18. These terms shall be governed by and construed in accordance with the laws of New Zealand and be subject to the exclusive jurisdiction of the New Zealand courts.
