These terms and conditions form your membership contract with Triathlon New Zealand Incorporated.

Definitions

1. Tri NZ’ means Triathlon New Zealand Incorporated
   ‘Membership’ means Triathlon New Zealand Membership
   ‘Membership Benefits’ means Triathlon New Zealand membership benefits, including membership discounts, services and products offered to you from time to time
   ‘Membership Card’ means any official Triathlon New Zealand membership card issued to you at any time
   ‘we’, ‘our’ or ‘us’ means Triathlon New Zealand Incorporated
   ‘our website’ means the Triathlon New Zealand Incorporated internet site located at www.triathlon.org.nz
   ‘Welcome Pack” means the pack sent to you following the acceptance of your membership application
   ‘Contact Details’ means Triathlon New Zealand Incorporated contact details:

Start of Membership

2. Your membership contract will commence when you receive your notification of acceptance of your membership application.

Membership Validity 

3. The Tri NZ Membership year runs from 1 November to 31 October. Membership for any particular year opens on 1 October, and membership applications accepted during the period 1 October to 31 October will be valid for up to 13 months to 31 October in the following year.

Your Membership Card

4. You must sign your membership card immediately upon receipt
5. You must keep your membership card in a safe place and advise us immediately at our Contact Details if your membership card is lost, damaged or stolen. There is a $5.00 fee to replace a lost, damaged or stolen membership card.
6. The membership card is non transferable
7. Your membership card has no credit, debit or charge facility of any kind
8. Your membership card must be used as identification at registration for all Tri NZ Sanctioned or organised events including My Sport Series Races.

Termination of Your Membership

9. You may terminate your membership with immediate effect by giving us notice at our Contact Details at any time
10. No refund of your membership fee or any part thereof will be made in any case of termination of your membership.
11. We may terminate your membership with immediate effect in accordance with the provisions relating to this in the Tri NZ Constitution.

Membership Benefits

12. All membership benefits that may be offered to you from time to time will be provided on a discretionary basis and may be revised, suspended or withdrawn by us at any time.
13. All offers of membership benefits shall be subject to these terms, any other rules or terms that may apply to any specific membership benefits and any user guides or other instructions given to you. The rules or terms of any specific membership benefits will prevail over the general terms in the event of any conflict.

Your Personal Information

14. We, our employees, sub-contractors and agents may use any personal information you provide or we otherwise hold about you (whether or not related or pursuant to this contract) to: 
    
    a.Identify you when you make enquiries by telephone, post, email or in person 
    
    b.Help administer your accounts (if any) and your membership benefits including to write to, email or telephone you with information about such membership benefits from time to time;
     
    c.Help us to detect fraud or loss 
    
    d.Write to, email or telephone you with information about other services and products offered by us and those of our selected partners or sponsors, and we may use information about your use of membership benefits, services and products to help us contact you about which such services and products are likely to be of interest to you.
15. You must keep your address or any other personal information up to date on our website by using your personalised log in and password, or by immediately in writing notifying us of these changes.

Other Rules

16. It is a condition of your membership that you abide by the Tri NZ Constitution and Tri NZ Race Rules, including all aspects relating to the drug codes of the World Anti Doping Agency and Drug Free Sport New Zealand.
17. By applying for membership, you acknowledge that Tri NZ is the governing body in New Zealand for Triathlon, Duathlon and Multisport and agree to recognise it’s authority to govern the sports of Triathlon, Duathlon and Multisport.

Liability

18. We warrant that the membership services we provide will be provided using reasonable care and skill. We do not warrant that the services will be uninterrupted or error free, and give no other warranty, guarantee or representation as to the performance of any of the same.
19. Nothing in these terms will affect your statutory rights as a consumer

Changes to these terms

20. We may make additions or changes to these terms on the giving of reasonable notice, where we reasonably consider it necessary to do so. If the addition or change is to your detriment, you may, within 21 days of us giving you notice of the addition or change, terminate your membership under clause 9.
    General
21. We may provide any membership benefit to you through any agent or sub-contractor appointed by us in our absolute discretion.
22. Nothing in these terms shall give any rights to any person other than you.
23. These terms shall be governed by and construed in accordance with the laws of New Zealand and be subject to the exclusive jurisdiction of the New Zealand courts.
